{"id":803,"date":"2021-03-03T19:37:00","date_gmt":"2021-03-04T03:37:00","guid":{"rendered":"https:\/\/www.hillandpiibe.com\/?p=803"},"modified":"2024-08-07T09:24:34","modified_gmt":"2024-08-07T16:24:34","slug":"803","status":"publish","type":"post","link":"https:\/\/www.hillandpiibe.com\/en\/deportation-removal-detention\/2021\/03\/03\/803\/","title":{"rendered":"The New ICE Detention and Removal\/Deportation Priorities"},"content":{"rendered":"<p>The following is a summary of the new ICE memo issued on February 18, 2021, relating to ICE\u2019s detention and deportation priorities under President Biden.\u00a0 These policies are <strong><em>effective immediately<\/em><\/strong> for the next 90 days, and can impact current cases already in detention and\/or Immigration\u00a0 Court.\u00a0 It basically reverts to pre-Trump enforcement policies.<\/p>\n<p><strong>What actions\/cases are affected?<\/strong><\/p>\n<ul>\n<li>Whether to detain a person<\/li>\n<li>Whether to issue or follow through on a Notice To Appear (NTA) that places a person into deportation\/removal proceedings in Immigration Court<\/li>\n<li>Administrative violations<\/li>\n<li>Whether to stop, question or arrest someone for violating immigration laws<\/li>\n<li>Deferred Action and parole<\/li>\n<li>Executing a final deportation order (deporting a person)<\/li>\n<li>Allowing noncitizens to pursue relief from deportation (versus deporting them before they have the chance)<\/li>\n<\/ul>\n<p><strong>The good news\u2014lower risks and dangers for peaceful people<\/strong><\/p>\n<p>For most \u201cregular\u201d people who otherwise have a clean record and are good citizens, ICE cannot go after them unless there is pre-approval in writing.\u00a0 This means no random stops due to race or suspicions of \u201cillegal\u201d status.\u00a0 Also, even if one person is targeted for an ICE raid, officers cannot also arrest the other members they may find in a household or building.\u00a0 Finally, ICE must maintain a record of requests and their responses for \u201cprosecutorial discretion,\u201d which means requests for exercising leniency and forgiveness&#8211; this results in accountability to answer.<\/p>\n<p><strong>Priorities of enforcement: terrorists, certain criminals, and recent unlawful entries <\/strong><\/p>\n<p>As stated, most\u00a0 people are no longer subject to random arrest, detention and deportation\/removal.\u00a0 But the following people who meet these descriptions will still be pursued by ICE:<\/p>\n<ol>\n<li><strong><em>National Security <\/em><\/strong>\n<ul>\n<li>Terrorism-related activities<\/li>\n<li>Espionage-related activities<\/li>\n<li>Anything else otherwise necessary to protect national security\u2014note that criminal activity does not fall into this category<\/li>\n<\/ul>\n<\/li>\n<li><strong><em>Border Security<\/em><\/strong>\n<ul>\n<li>Apprehended while attempting to enter unlawfully on or after <strong>November 1, 2020<\/strong><\/li>\n<li>Not physically present in the US before <strong>November 1, 2020<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong><em>Public Safety<\/em><\/strong>\u2014must meet <u>both<\/u> requirements:\n<ul>\n<li>Requirement One: Criminal activity:\n<ol>\n<li>Aggravated felony at any time OR<\/li>\n<li>Gang offense OR<\/li>\n<li>16 years or older and intentionally participated in gang activity<\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Requirement Two: Pose a threat to public safety. Factors to consider:\n<ol>\n<li>Seriousness and recency of the criminal activity<\/li>\n<li>Personal and family circumstances<\/li>\n<li>Ties to the community<\/li>\n<li>Rehabilitation<\/li>\n<li>Potential immigration relief<\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Compelling reasons for removal of certain vulnerable people <\/strong><\/p>\n<p>ICE must show compelling reasons and get approval from their Field Office Director before removing\/deporting the following vulnerable people:<\/p>\n<ul>\n<li>Elderly or serious physical\/mental illness<\/li>\n<li>Currently on appeal with the Circuit Courts<\/li>\n<li>Filed only one Motion to Reopen in removal proceedings<\/li>\n<li>Currently waiting for an immigration benefit\/relief and are eligible for the relief<\/li>\n<\/ul>\n<p><strong>ICE is reviewing its cases <\/strong><\/p>\n<p>ICE has been ordered to review detentions and deportation\/removal cases to see if they should continue.\u00a0 This could result in people being released, or in cases being put on hold or even dismissed in Immigration Court.\u00a0<\/p>\n<p><strong>What you should do now <\/strong><\/p>\n<p>Consult with a competent immigration attorney who is familiar with detention and removal cases\u2014it may be possible to request release, postponement or termination of such a case.\u00a0 Hill &amp; Piibe commonly handles detention\/removal cases and can answer your questions about your own options, or those of your family and friends.\u00a0 If you or someone you know are arrested, detained or in removal proceedings, our litigation attorneys can assist you.\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The following is a summary of the new ICE memo issued on February 18, 2021, relating to ICE\u2019s detention and deportation priorities under President Biden.\u00a0 These policies are effective immediately for the next 90 days, and can impact current cases already in detention and\/or Immigration\u00a0 Court.\u00a0 It basically reverts to pre-Trump enforcement policies.
